What is a public record?

A "public record" includes any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained by any state or local agency regardless of physical form or characteristics.  "Writing" means any handwriting, typewriting, printing, photographing, photocopying, transmitting by electronic mail or facsimile, or any other means of recording or form of communication or representation, including letters, words, pictures, sounds, or symbols, or combinations thereof.  [California Government Code section 6252(g)]

The City of Victorville is not required to create a record that does not exist at the time of the request.

Is there a charge for records?

Electronic copies, if available, are provided at no cost. Printed copies are $0.10 per page for 8 ½” x 11” black and white copies.  Additional costs may apply for other sizes and/or color copies and postage. The City of Victorville can charge direct duplication costs for oversized documents or records maintained on non-paper media. 

How long do I have to wait?

The City has 10 days from receipt of the request to determine whether the request, in whole or in part, seeks copies of disclosable public records in the City's possession and to notify the requester of that determination. When necessary, the initial 10-day period may be extended for up to 14 additional days by written notice to the requester, setting forth the reason for the time extension as required by the Act.

What is the California Public Records Act?

The California State Legislature adopted the Public Records Act in 1968.  It is designed to give the public access to information in the possession of public agencies.  The public can inspect or receive a copy of any record unless it is exempt from disclosure under the Act.
